Terms of Service

By creating an account or using ContentPilot (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all users, including free trial users, subscribers, and any organisation accessing the Service on behalf of its members.

ContentPilot is an AI-powered content scheduling and generation platform operated by AI Ellipse Studio. The Service allows users to generate, review, approve, and manage social media content for their clients. ContentPilot uses third-party AI models to assist in content creation; outputs are drafts intended for human review before publication.

You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@ellipsestudio.com.au if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.

New accounts may be eligible for a limited free trial period. At the end of the trial, continued access requires a paid subscription. We reserve the right to modify or discontinue the trial offer at any time without notice.

Paid plans are billed on a recurring basis (monthly or annually) via Stripe. By subscribing, you authorise us to charge your payment method at the start of each billing period. All fees are in Australian Dollars (AUD) unless stated otherwise. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are issued at our discretion; please contact us within 7 days of a charge if you believe it was made in error.

You agree not to use the Service to generate content that is unlawful, defamatory, abusive, harassing, fraudulent, or that infringes the intellectual property rights of others. You may not attempt to reverse-engineer, scrape, or otherwise extract data from the Service, or use it in a way that places unreasonable load on our infrastructure. We reserve the right to remove content and suspend accounts that breach these rules.

You retain ownership of any content you upload or input into the Service ("Your Content"). By using the Service you grant AI Ellipse Studio a limited licence to process Your Content solely to provide the Service to you. AI-generated drafts produced by the Service are provided to you for your use; you are responsible for reviewing them before publication and ensuring they comply with applicable laws and platform policies.

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Service you consent to such processing. We do not sell your personal data to third parties.

The Service integrates with third-party platforms (such as social media networks and AI providers). Your use of those platforms is subject to their own terms and policies. We are not responsible for any changes, downtime, or data handling practices of third-party services.

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for any particular purpose. You use the Service at your own risk.

To the maximum extent permitted by law, AI Ellipse Studio and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability to you shall not exceed the total fees paid by you in the 12 months preceding the claim.

You may cancel your subscription at any time from the Account page. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your access at any time for breach of these Terms, non-payment, or for any reason with reasonable notice. Upon termination, your data may be deleted after a 30-day grace period.

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
